Acceptable use policy

This Acceptable Use Policy ("AUP") sets out what you may and may not do with mailboxes, domains and infrastructure provisioned by Cladiant, LLC. It forms part of our Terms & Conditions, and breaching it is grounds for immediate suspension.

We sell infrastructure for legitimate business-to-business outreach. We do not sell spam capacity, and we enforce this policy - the credibility of every one of our customers' sending domains depends on it.

Your responsibilities

  • Have a lawful basis to contact each recipient, and be able to show it. Requirements differ by jurisdiction - CAN-SPAM, GDPR, PECR, CASL and others - and both your location and your recipient's matter.
  • Identify yourself honestly. Accurate sender name, a real reply-to address you monitor, and your genuine business identity and postal address where the law requires it.
  • Offer a clear opt-out and honour it promptly. Stop contacting anyone who asks, across every domain and mailbox you run with us - not just the one they replied to.
  • Source and maintain your own lists. Keep them clean, remove bounces and complaints, and do not mail scraped, purchased or harvested addresses without a lawful basis.
  • Warm up and ramp sending sensibly, and stay within the volume the mailboxes you ordered are provisioned for.
  • Keep your credentials secure and remain responsible for everything sent under your account, including by your team and any client you send on behalf of.

Prohibited content

You must not send, host, or link to:

  • Phishing, spoofing, credential harvesting, business-email-compromise attempts, or any message impersonating another person or organisation.
  • Malware, ransomware, spyware, or malicious attachments and links.
  • Fraudulent, deceptive, or misleading offers - including fake invoices, advance-fee schemes, pyramid or matrix schemes, and unsubstantiated earnings or health claims.
  • Content that is unlawful, defamatory, obscene, sexually explicit, or that harasses, threatens, or incites violence or hatred against any person or group.
  • Material that infringes someone else's intellectual property, privacy, or publicity rights.
  • Unlicensed or unlawful promotion of regulated goods and services - pharmaceuticals, controlled substances, weapons, gambling, adult services, cryptocurrency investment schemes, high-risk financial products, or debt and credit-repair offers.

Prohibited conduct

  • Sending bulk unsolicited mail, or any sending that generates abnormal complaint, bounce, or spam-trap rates.
  • Evading filters, blocklists, or a suspension - including by rotating to fresh domains or accounts to continue sending that has already been stopped.
  • Reselling or sublicensing Cladiant mailboxes without a written reseller agreement.
  • Using the mailboxes as a general-purpose relay for third parties, or transferring credentials to anyone outside your account.
  • Scraping, overloading, probing, or attempting unauthorised access to our platform, our providers, or another customer's data.
  • Breaching the terms or acceptable-use policies of the underlying providers - Google, Microsoft, Azure - or of your sending platform. Their rules apply to you in full, on top of this policy.

Reporting abuse

If you believe mail sent from infrastructure we provisioned breaches this policy, email support@cladiant.com with the full message headers and the sending address. We investigate every report and aim to acknowledge within one business day. To stop receiving mail from a particular sender, use the opt-out in their message - we do not control their lists, but we do act on senders who ignore opt-outs.

Enforcement

Where we have reason to believe this policy has been breached we may - proportionately to the severity and with notice where it is safe to give it - throttle or pause sending, suspend individual mailboxes or domains, suspend or terminate the account, and report unlawful activity to the relevant authorities or providers. Serious cases (phishing, malware, fraud) are actioned immediately and without notice.

Fees already paid are not refunded where we suspend or terminate for a breach of this policy - see the Refund & Cancellation Policy. If you think we got it wrong, reply to the suspension notice and a human will review it.

We may update this policy as sending standards and provider requirements change; the "Last updated" date above reflects the current version.
